Meestal wordt bij de fondsenwerving een beroep gedaan op particuliere donateurs. Vaak denken de fondsenwervers dat de particulieren zich makkelijker tot betaling van grotere bedragen laten overhalen als er een fiscaal voordeel is.
In dat kader wil ik graag wijzen op artikel 6:32 en volgende van de Wet op de inkomstenbelasting (IB). Dit keer ga ik echter niet in op de peridodieke schenkingen als bedoeld in artikel 6:34 IB, maar juist op de éénmalige en toch aftrekbare giften.
Volgens artikel 6:31 lid 1 sub b zijn namelijk ook aftrekbaar van de inkomstenbelasting de “andere giften”. In artikel 6:35 IB wordt dan vermeld dat deze “andere giften” ook giften aan steunstichtingen SBBI zijn.
SBBI staat voor: sociaal belang behartigende instelling (SBBI). De belastingdienst geeft als voorbeelden van SBBI’s: zangkoren en dansgroepen, muziek- en harmonieverenigingen, sportclubs, speeltuinen, personeelsverenigingen, ouderenverenigingen, lokale scoutingclubs, amateurtoneelverenigingen en -theatergroepen.
Voor de duidelijkheid: een gift aan de SBBI zelf is niet aftrekbaar. Een gift aan de steunstichting mogelijk wel.
Er is een Uitvoeringsregeling waarin de eisen zijn vermeld waaraan de steunstichting moet voldoen, wil de éénmalige gift aftrekbaar zijn. Met name hetgeen in artikel 1f van deze Uitvoeringsregeling is vermeld kan problemen opleveren voor goed bedoelende vrijwilligers die geld inzamelen voor de Harmonie.
Met name is van belang dat slechts één keer per vijf jaar de steunstichting als Steunstichting SBBI kan worden aangemerkt. Bovendien dient er sprake te zijn van een “viering” in dat jaar. Eigenlijk wordt daarmee bedoeld dat voor een Lustrum geld ingezameld kan worden waarbij de belastingdienst een en ander fiscaal aantrekkelijk maakt.
Dat dit geen loze eis is, blijkt uit lid 2 van artikel 1f van het Uitvoeringsreglement waarin staat dat bij de inzamelingsactie duidelijk aangegeven moet worden voor welk “Lustrum”-jaar de inzameling bedoeld is. Het niet duidelijk naar voren brengen van dat jaar betekent dat de giften niet aftrekbaar zijn van de inkomstenbelasting.
Gelukkig is in de regeling wel opgenomen dat de steunstichting kan kiezen uit:
= het Lustrum jaar zelf; of
= het jaar voorafgaand aan het Lustrum jaar; of
= het jaar na het Lustrum jaar.
Dus de fondsenwerving kan plaatsvinden voordat het speciale jaar zich aandient, zodat er geld in kas is. Of in het jaar na de viering (om de kas weer aan te vullen nadat alle betalingen zijn geweest), dan wel in het Lustrum jaar zelf. De keuze is aan het bestuur van de steunstichting.
Wat betekent dit nu voor de Harmonie waar vrijwilligers zich willen inzetten om geld in te zamelen voor nieuwe uniformen of instrumenten ? Ik ga er daarbij van uit dat zij de aftrekbaarheid van giften willen gebruiken om meer donateurs te vinden of deze hogere bedragen te laten schenken.
Allereerst moet er een stichting worden opgericht waarvan de statuten voldoen aan de vereisten van het Uitvoeringsreglement. Vervolgens moet gezocht worden naar een “Lustrum”. En alleen in dat jaar (of ter keuze van het bestuur het jaar ervoor of het jaar erna) kan de donateur zijn schenking in mindering brengen op het verzamelinkomen.
Een fondsenwervingsactie voor nieuwe instrumenten of uniformen omdat deze versleten zijn, past niet in dat kader.
